Distance Service Agreement
DİSTANCE SERVİCE AGREEMENT
This agreement is concluded electronically between the service provider and the customer who purchases services through the website. Customer:The person who purchases or reserves services through the website.
- 30-Day Rule: If the consumer requests cancellation up to 30 days before the start of the tour, a full refund is usually issued.
- Last-Minute Cancellations: For cancellations made 29-15 days before the start of the tour, a 35% refund is usually charged by the agency.
- For cancellations made less than 15 days before the start of the tour, a full refund is usually charged.
- Flight/Train/Sea Tickets: Regardless of the cancellation period, flight, train, and sea tickets included in the package tour may not be refundable.
- Agency Cancellation: If the agency cancels the tour due to insufficient participation or force majeure, it is obliged to refund the participant within 14 days.
- Force Majeure: In cases such as adverse weather conditions, war, terrorism, and natural disasters, the parties may terminate the contract.---
- Visa Refund: If visa procedures have been completed, visa fees are not refundable even if the tour is cancelled. No-Show: If the customer does not notify the agency of their non-participation before the tour begins, the agency may cancel all reservations after 24 hours and usually does not issue a refund.
- Obligation: For sales made remotely (via website, application), a distance selling contract is a legal requirement. Content: The contract must include information about the seller and buyer, the characteristics of the service, the right of withdrawal (with exceptions), payment terms, and dispute resolution methods.
- Exception to the Right of Withdrawal: According to Article 15 of the Law on Consumer Protection; the 14-day right of withdrawal generally does not apply to tourism services offered on a specific date or period, such as accommodation, transfer, car rental, food service, or entertainment.
- Preliminary Information: It is mandatory for the consumer to be informed about all aspects of the service and the agency's responsibilities before the contract is concluded.
- Agency Responsibility: The travel agency is directly responsible for the performance of the service it has undertaken and for any problems that may arise in package tours in transactions made through distance selling.
- Duration: Generally 1 year, and may be extended unless written notice is given 30 days in advance.
- Scope of Service: Includes transportation, accommodation, and other tourism services.
- Parties: Travel agency (sub-agency or tour operator) and customer/business partner.
- Data Protection: Passenger records, passport information, contact and payment data are kept confidential. Purpose of Use: Data is processed only for reservation and service provision purposes and cannot be used for other purposes.
- Legal Obligation: Data security is ensured within the scope of the KVKK (Personal Data Protection Law).
- Duration: The contract may bind the parties for a specific period or continuously (indefinitely). Cancellation Terms: Except for force majeure events (weather conditions, strikes, etc.), customer information is kept confidential.
